With 164 car parks over four levels, your shopping experience will be seamless from beginning to end

The parking management system will guide you to available spaces and provide easy to use technology to obtain free parking with purchases from any of Thirty Eight Elizabeth’s stores. Don’t forget to make a note of your license plate number as you will need this at the Pay Station.

First Avenue customer parking entry

Entrance to customer parking is via First Avenue to Level 2.

Please note the customer carpark is not accessible from Elizabeth Street. The parking entrance on Elizabeth Street is only accessible to the residents of Elizabeth Towers.

Parking fee payments are card-only. No cash payments can be made at our Pay Stations.

Parking at Thirty Eight Elizabeth

Customer parking entrance

Thirty Eight Elizabeth has 164 carparks over four levels available for customer parking. Entrance to our parking is via First Avenue to Level Two.

Please note the customer carpark is not accessible from Elizabeth Street. The parking entrance on Elizabeth Street is only accessible to the residents of Elizabeth Towers.

License plate scanning

Thirty Eight Elizabeth features the latest license plate scanning technology, so no ticket is issued on entry. To pay for parking, just enter your licence plate number on your exit at any of the Pay Stations located on the Ground Floor and Level Two. Don’t forget to make a note of your license plate number as you will need this at the Pay Station.

Card only parking fee payments are accepted

There is no provision for cash payments to be made at our Pay Stations.

Free parking validation for customers

For your convenience, Thirty Eight Elizabeth has free customer parking for up to three hours (P180).

You can validate your free parking by scanning the QR code at any Pay Station received from any retailer or eatery purchase (over $10) you received the same day as your parking.

If you park longer than the three-hour free parking allocation or if you don’t have a valid purchase receipt, you can pay for your parking by entering your license plate number on any of the Pay Stations located on the Ground Floor and Level Two.

Accessible parking

Thirty Eight Elizabeth has 10 accessible parks, five located on the Ground Floor level and another five located on Level Two.

Parking with prams

There are three parks provided on the Ground Floor Level to make it easier for those with young children.

Electric vehicle chargers

Thirty Eight Elizabeth has two electric vehicle charging bays located on Level One.

 
Parking Terms and Conditions
1 .  Terms and Conditions

1.1  By entering this Car Park you agree:

(a)   to pay the parking charges as displayed in the schedule of fees and opening hours [at the entrance to the Car Park][set out below]; and

(b)  to be bound by these Terms and Conditions. 

If you do not accept these Terms and Conditions you must immediately proceed to the nearest exit and leave the Car Park. 

2.  Fees

2.1  You will be charged on an hourly basis in accordance with the schedule of fees and opening hours [displayed at the entrance to the Car Park][set out above].

2.2  We may prevent the exit of a vehicle from this Car Park until we are satisfied that any fee due has been paid.

3.  Compliance with signs, directions, hours of operation

3.1  You must, while in the Car Park, comply with all signs and directions, and all requests made by us.  In particular, you must:

(a)  not cause any obstruction in the Car Park;

(b)  not park anywhere that we designate as a no parking or reserved area unless you are authorised by us to park in those areas;

(c)  not use the Car Park other than in accordance with the signage and markings in the Car Park and any instructions we may give you;

(d)  not use parking bays set aside for mobility impaired and/or disabled persons unless you are lawfully entitled to use these bays and you display clearly on your vehicle a current permit;

(e)  not use parking bays set aside for “Car Pool/Fuel Efficient or Hybrid” vehicles unless your vehicle displays the appropriate designation and is of appropriate engine capacity or type; and

(f)  gain access to or remove a vehicle only during the opening hours we display in the Car Park.

4.  Our rights in respect of your vehicle

4.1  We may deny you access to the Car Park, or may enter, move, drive or park any vehicle by towing or otherwise, at any time if required by law or reasonably necessary for the safe operation of the Car Park. 

4.2  We may prevent exit of a vehicle until we are provided with evidence of ownership or entitlement to receive the vehicle that is satisfactory to us. 

4.3  In the event that your vehicle is left in the Car Park for a continuous period in excess of 24 hours then we may move the vehicle by towing or otherwise at your expense.

4.4  In the event that you breach these Terms and Conditions we may:

(a)  Issue an enforcement notice; or

(b)  move or remove and store a vehicle (at your risk and expense); or

(c)  apply a wheel clamp to your vehicle and recover the costs of doing so from you. No clamped vehicle will be released until all costs (including parking fees accruing on an hourly basis) are paid in full.

5.  Use

5.1  You may not distribute pamphlets or other promotional materials, engage in any commercial activities, or use skateboards, scooters, roller blades or similar equipment  in the Car Park. 

5.2  You must not bring or leave in this Car Park any offensive, hazardous or dangerous substance or thing, nor anything which may be or become a danger, nuisance or inconvenience to us or to any person lawfully in or about this Car Park.

6.  Risk and Liability

6.1  You enter and use the Car Park at your own risk in every respect. While we take reasonable care to keep the Car Park safe we cannot guarantee the safety of your vehicle. 

6.2  To the extent permitted by law, we are not liable for, and you indemnify us against, any cost, expense, liability, loss, damage, claim or proceeding (whether direct or indirect, howsoever rising) we suffer or incur in relation to:

(a)  personal injury to or death suffered by you or any person; or

(b)  theft, loss of, destruction or damage to, any vehicle, its parts or accessories, any property on or in a vehicle or elsewhere in the Car Park or any damage to the Car Park, arising out of, or in any way relating to your use of the Car Park , except to the extent that any liability is caused or contributed to by our negligence or breach of these Terms and Conditions .

7.  Parking guidance and license plate recognition cameras

7.1  This Car Park uses licence plate recognition cameras and parking guidance systems for security and operational monitoring purposes.

7.2  We may collect information to assist us to manage and improve the operation of the Car Park. We may also use this information for measuring and analysing car parking dwell times and shopper behaviour, marketing purposes, security purposes and to assist you to locate available car spaces and your car. 

7.3  By entering the Car Park, you consent to us collecting and using this information. We will keep this information secure and treat this information in accordance with our Privacy Policy. For our Privacy Policy please email enquiries@38elizabeth.co.nz

8.  Definitions and Interpretation

8.1  Car Park means all the property constituting the Car Park including any entry and exit ramps, loading docks, driveways and elevators and stairways servicing the Car Park.

8.2  Us and we means Elizabeth Properties Limited (EPL) or the owner of 38 Elizabeth Street, Tauranga from time to time, and their related bodies corporate, employees, agents and subcontractors (and our has a corresponding meaning).

8.3  Terms and Conditions means these terms and conditions as may be amended by us from time to time.

8.4  You and your refers to and includes each person who enters the car park in any manner and any owner of a vehicle which enters the car park.6
